These General Terms and Conditions of Sale (hereinafter the “GTC”) govern the sale of products carried out on the website https://www.brix.cool

(hereinafter the “Site”), operated by the company BrixCool, to any person making a purchase via the Site (hereinafter the “Customer”).

2. PURPOSE

These GTC define the conditions under which BrixCool markets, via its Site, brick construction products intended for private individuals and professional customers, primarily located in France or within the European Union.

Any order placed on the Site implies full and unconditional acceptance of these GTC.

3. PRODUCTS

The products offered for sale are those described on the Site on the date the Customer consults it.

BrixCool takes the greatest care in presenting and describing its products. However, photographs and illustrations are for indicative purposes only and have no contractual value.

BrixCool creations are compatible with market brick standards, without being affiliated with, associated with, or endorsed by any third-party brand.

4. PRICES

Prices are indicated in euros (€), all taxes included (VAT), excluding any delivery costs.

BrixCool reserves the right to modify its prices at any time. The price charged is the one in force at the time the order is validated.

Delivery costs are specified before the final validation of the order.

5. ORDER

An order is validated when the Customer:

1. Selects the products,
2. Reviews the order summary,
3. Accepts these GTC,
4. Proceeds with payment.

Any confirmed order constitutes final and binding acceptance.

BrixCool reserves the right to refuse or cancel any order in the event of a previous dispute with the Customer.

6. PAYMENT

Payment is due immediately upon ordering.

The accepted payment methods are those indicated on the Site at the time of the order.

Transactions are secure. BrixCool never has access to the Customer’s banking details.

7. DELIVERY

7.1 Delivery areas

BrixCool delivers primarily within the European Union.

7.2 Delivery times

Delivery times are provided for information purposes only at the time of ordering. Any delay shall not give rise to damages or compensation.

7.3 Transfer of risks

The risks are transferred to the Customer upon receipt of the products.

8. RIGHT OF WITHDRAWAL

In accordance with applicable legal provisions, the private Customer has a period of 14 days from receipt of the product to exercise the right of withdrawal.

The Customer must notify their decision by email at: contact@brixcool.com

Products must be returned:

– in their original packaging,
– complete,
– with the sealed bags containing the construction bricks unopened.

Return shipping costs remain the responsibility of the Customer.

9. RETURNS – REFUNDS

In the event of a defective or non-compliant product, the Customer has a reasonable period of time to contact BrixCool.

After verification, BrixCool will proceed, at its discretion:

– with an exchange,
– or with a refund.

10. LIABILITY

BrixCool cannot be held liable for:

– improper use of the product,
– indirect damages,
– incompatibility resulting from non-compliant use.

In any event, BrixCool’s liability is limited to the amount of the order.

11. INTELLECTUAL PROPERTY

All elements present on the Site (texts, images, graphics, products, logos) are protected by intellectual property law.

Any unauthorized reproduction or use is strictly prohibited.

12. PERSONAL DATA

Personal data collected in the context of orders is processed in accordance with the Privacy Policy available on the Site.

The Customer has the right to access, rectify, and delete their data by contacting: website@brix.cool

13. APPLICABLE LAW – DISPUTES

These GTC are governed by French law.

In the event of a dispute, an amicable solution will be sought before any legal action.
Failing that, the French courts shall have exclusive jurisdiction.

14. LANGUAGE

These GTC are written in French.
In the event of translation, the French version shall prevail.
